'Speeding' driver angry over van rules

Sep 21 2004

By Richard Warburton, The Birmingham Post

A motorist from Warwick-shire has been convicted of travelling at 58mph in a 60mph zone - because the van he was driving is banned from going so fast.

Guy Litton, aged 44, was fined £60 and received three penalty points despite not knowing the van he was driving is restricted to 50mph in a 60mph area.

Not even the police officer from the Camera Enforcement Unit that trapped him realised the VW Transporter was subject to different speed limits.

Since being caught on a single carriageway in the Warwick-shire countryside near Stratford-upon-Avon, Mr Litton has learned his class of vehicle can do 70mph on a motorway but is restricted to 50mph in a 60mph zone on a single carriageway.

Mr Litton, a father of one from Rugby, Warks, said: "It's a farce and just another cunning trick to pick the pockets of innocent motorists. Even the police were mystified.

"When I called in to Stratford police station and showed them the ticket, the duty officer was puzzled.

"If even a police officer is unaware of the law, what chance have we got?

"If there is a different limit for different types of vehicles then it should be displayed at the roadside.

"I know ignorance of the law is no excuse but there are so many obscure ones that the man in the street can't possibly be expected to know them all."

Mr Litton said he is planning to go to court "if only to show that I am an ordinary, careful driver who takes pride in his professional job and would never knowingly break a speed limit."

Stephen Rumble, communications manager with Warwickshire Road Safety Reduction Partnership, conceded there were confusing technicalities.

"What is important is what the Highway Code says and drivers should do regular checks."
