Anger over death case, 10 years on

Jan 28 2008

By Mark Cowan, Birmingham Mail

A LAWYER representing a doctor facing extradition over the death of a Stafford hospital patient ten years ago described the case against her as "inexplicable".

Anaesthetist Dr Priya Ramnath was arrested last month outside a Texas hospital and spent Christmas and New Year in custody.

Staffordshire Police want her over the death of Patricia Leighton, aged 51, of Burntwood, in July 1998.

She is alleged to have injected Mrs Leighton with adrenaline against the advice of colleagues when she went into septic shock at Stafford-shire General Hospital, where she was being treated for an infected bunion.

Mrs Leighton suffered a heart attack and died, and a coroner ruled in 2004 that she was unlawfully killed.

Dr Ramnath, who moved to the US a short time later, was charged with manslaughter but escaped prosecution because the Crown Prosecution Service missed a five-year deadline to apply for extradition.

New laws now make it possible for her to be brought back to Britain and an extradition hearing has been set for February 15.

Dr Ramnath's lawyer, Ben Rose, said: "She did everything she could to save the patient's life. Ten years later, the CPS accuses her of manslaughter. "Having carefully reviewed the evidence, a US federal judge has expressed grave concerns and granted bail."

Mr Rose added: "In spite of all of this, the CPS refuses to justify its inexplicable decision to continue with this case."

A spokeswoman for the Crown Prosecution Service said: "We would not seek extradition if we didn't feel we had sufficient evidence."
